Special Commissioner has learned of a written lease for the tillable land on the Property. Special Commissioner believes but does not warrant that the lien of the judgment in favor of First Bank Successor by Merger with Touchstone Bank is superior to the rights conferred by the lease and that the sale extinguishes the rights under the lease other than the rights to the crops currently planted. See First National Bank v. McGraw, 85 W.Va. 298, 101 S.E. 474 (1919). In connection with requesting court approval of a contract, the Special Commissioner will request that the Circuit Court for Southampton County order and put language in the order approving a contract that the sale extinguished the rights under the lease other than the rights related to the crops currently planted; however, Special Commissioner does not warrant the Court will make such order and include such language.
Agent for Special Commissioner: The Auctioneer does not own the property being sold in this auction. The Auctioneer is representing Timothy G. Moore in his capacity as Special Commissioner appointed by the Circuit Court of Southampton County, Virginia (the “Court”) in Case Number CL19-000743-00 (the “Special Commissioner”) exclusively in this auction transaction and any references to “Seller” or "Sellers" in any materials related to the sale of the property shall refer to the Special Commissioner.
